Terms and Conditions of Use and Sale

The following conditions are a translation of the original Terms and Conditions of Sale, which are in Italian.  For a better understanding of the rules related to sales and purchases, we invite Users to self-translate the official version of these conditions from Italian.


Conditions of sale

The owner of the easypreno.it website is I.A.M.G. Project S.r.l., with registered office in Frazione Orzoni, 9 - 27049 Stradella (PV),  VAT 02828290185.
I.A.M.G. Project S.r.l. (hereafter: “I.A.M.G. Project” or “Owner”) provides an online platform that makes services advertised by Organizers available to Users, such as, but not limited to, guided tours, tastings and seat reservations, etc.

Definitions

USER: person over 18 who uses the website for the purpose for which it was developed
ORGANIZER: private users or professionals who advertise their services on the EasyPreno Platform
SERVICE: all the offers published by the organizers on the EasyPreno Platform (See 1. Description of the services)
EASYPRENO PLATFORM: aggregator of services which are advertised by third parties made available by I.A.M.G. Project. It is responsible only for the management of reservations made by Users of the Organizers' services and intervenes to try to resolve cases of dispute between the parties. It cannot be held responsible in the event of failure to provide the service by the Organizer.


1. Description of the services

1.1 The website allows Organizers to advertise one or more services and it allows Users to book or pre purchase the services that make up the offer of EasyPreno or to request information about the price or the disponibility. The website represents a place of interaction between Organizers and Users, meant to facilitate the booking of services and their fruition by Users.

1.2 I.A.M.G. Project commits to provide detailed descriptions of the proposed services and to promptly update them in case of variations of the characteristics or the price of the services, every time the Organizers will send said information.


2. Acceptance of the conditions of sale

2.1 This regulation represents the ensemble of the General Terms and Conditions of Sale of the EasyPreno platform. Aside from this general regulation, for the different types of services on the website there are also more specific terms inside the individual product sheet, which are explicitely accepted along with this regulation to finalized the order of products or services.

2.2 By singning in and placing an order in the various ways provided, the User explicitly declares that they have read the information provided during the purchase procedure and accepts the conditions transcribed below, including the specific parts of each Service published.
The User is therefore invited to carefully read these conditions of sale and those relating to the services they intend to purchase and to print them or save them on another durable medium accessible to them.

3. Prices

3.1 All sales prices shown on the easypreno.it website are expressed in Euros inclusive of VAT, unless otherwise indicated.
The prices shown are subject to possible variation without any obligation to give notice of the changes to the Users.


4. Listings and Conditions

4.1 The Organizer is solely responsible for the information included in their service listing. Each Organizer declares that all information provided to I.A.M.G. Project and to Users, in particular those relating to prices, calendar availability, services offered and service characteristics, are truthful and updated during the entire period of publication of the announcement on the site. If any dispute arises between the Organizer and the User caused by a lack of foresight on the part of the Organizer, I.A.M.G. Project will act as a mediator between the parties, while the ultimate responsibility towards the User and I.A.M.G. Project will rest with the Organizer. It will be the Organizer's responsibility to keep this data constantly updated. I.A.M.G. Project does not guarantee the accuracy or updating of the texts, photos, contents published on the Site.

4.2 The Organizer declares to publish only original photos, videos and texts in their listings. They also declare not to make use of images or videos for which they do not have legal consent, which violate the law on the protection of personal data, intellectual property rights or any other right of third parties. In case of violation of these conditions, they will assume full responsibility in this regard. The Organizer grants I.A.M.G. Project a non-exclusive and transferable license to use the photographs, videos and texts published in the advertisement for commercial or promotional purposes.


5. Purchase Procedure

5.1 Each order sent is considered an offer to book a service. Orders are subject to availability and discretionary acceptance by I.A.M.G. Project.

5.2 The User must select the services and complete the check-out, after carefully checking the information contained in the order summary.
The order is placed through its confirmation and is subject to the payment of all the items indicated in the Order Summary form.

5.3 The Order Processing Receipt does not constitute acceptance of the order. The conclusion of the contract takes place when I.A.M.G. Project sends the Order Confirmation to the email address provided by the User, containing the instructions for obtaining a unique code relating to the Customer ‘s reservation which will be used to authenticate the User and allow them to access the selected service (hereinafter: "PrenoCode").
The Owner reserves the right not to confirm an order, should the availability of one or more services cease or due to cancellation by the Organizer, communicating to the User via the email address provided during registration, the possible unavailability of one or more of the purchased services.

5.4 These rules apply in particular to those services that are activated only upon reaching a minimum number of reservations or a minimum participation fee.
As described in the specific terms of the product (in its product sheet), any failure to reach the minimum number of participants will result in the cancellation of the order and the ensuing refund, as described below.

5.5 After I.A.M.G. Project has sent the Order Confirmation, it is no longer possible to change your order.


6. Payment methods

The owner may, in some cases and for some services, delegate the collection of the transaction and the consequent issue of the receipt/invoice directly to partner companies.

6.1 The site uses third-party payment processing tools and does not in any way come into contact with the payment data provided, such as, for example, that relating to the credit card.
The Owner cannot be held responsible for any refusal of payment by payment system providers or for direct or indirect consequences deriving from the use of the credit card to make the payment.
Any management costs of non-accepted payments will be charged to the User.

6.2 The following methods are accepted: Credit card, Bank transfer.
In case of payment made by bank transfer, the order will not be considered confirmed until payment is received.

I.A.M.G. Project reserves the right to cancel orders placed by bank transfer if the payment does not arrive within three working days following the booking of the service.

6.3 It is also possible to get fidelity points directly on EasyPreno (hereinafter: "PrenoPoints") which can be used within the platform to lower the total price of the cart or to pay it in full.
Fidelity points, as a manifestation of customer loyalty towards the EasyPreno platform, can be accumulated and have no expiry date.
In the event of withdrawal or cancellation by the Organizer, these points will be instantly re-credited to the User and can be reused immediately for the booking of other services (see article 9. "Consumer’s right of withdrawal" and art. 10. "Right of Cancellation").

6.4 Customers who decide to book services through the payment methods listed in point 6.1 will be entitled to get a certain number of PrenoPoints for each service booked, corresponding to a variable percentage of the price of the service.
Once a sufficient amount of loyalty points has been accumulated, the User can use them to book a service or to lower the total cost of the cart.

6.5 Users who make a reservation through one of the available payment methods, adding the loyalty points accumulated as a result of previous purchases with these payment methods, will get PrenoPoints calculated only on the basis of the part not paid with points.


7. Microtransactions

7.1 Microtransactions are all transactions whose individual value is limited (definition explicitely inserted in the product description, if considered microtransaction).
For example: the single cost of €1 for a seat is considered a microtransaction, even if more than 10 are purchased at the same time: we consider the starting value, not its multipliers.

7.2 The following rules apply to all microtransactions made within EasyPreno:
   - Microtransactions can only be made by bank transfer, credit card for totals greater than or equal to €15.00 or, alternatively, it is possible to use PrenoPoint fidelity points
   - It is not possible to request the withdrawal of orders that constitute a microtransaction, regardless of the payment method used
These rules apply to all orders indicated by I.A.M.G. Project as microtransactions, no matter the total amount of the purchase.


8. Changes to the order

8.1 Any changes to the order can be made by contacting the EasyPreno staff who will try to comply with the Clients' requests, but does not guarantee the possibility the making these changes due to the products' characteristics and Organizers' guidelines.

8.2 The request to modify the order can be made exclusively before the issuing of the reservation QR code for the service.
Once the code has been issued by I.A.M.G. Project it won't be possible to request any changes.

9. Consumer’s right of withdrawal

9.1 These regulations represent the set of General Terms  of Withdrawal of the EasyPreno Platform. Where present, the User has to comply with the Terms of Withdrawal present in the product sheet of the individual services.

9.2 Pursuant to art. 52 of Legislative Decree 21/2014, if the Customer has purchased one or more services that do not meet their needs, they can exercise the Right of Withdrawal (cancellation, modification of the purchase or modification of the booking date and/or time). To exercise this right, the User must send a communication to the email address info@easypreno.it, reporting the references of the purchase order.

9.3  All refunds will be made entirely in fidelity points. PrenoPoints are to be understood as recognition of the Customer's loyalty towards EasyPreno, as well as being a tool to facilitate the service booking experience within the platform. Under no circumstance may the conversion of fidelity points into monetary value be requested. 

Alternatively for some products, a possibility explicitly regulated in the relevant section of the event for which the booking was purchased, the user can request a cash refund by bank transfer, net of a cost for the refund procedure equal to €5.00 for each order subject to request.

9.4 Each Customer who decides to book services using the options listed in point 6.1 as a payment method will be entitled to get a number of PrenoPoints calculated on the base of the price of the Service for which withdrawal or modification of the date and/or of the timetable, minus the commissions relating to the selected payment method, according to the following methods:

   - Up to 7 days before the event, the number of fidelity points awarded is equal to 100% of the amount of the service purchased, net of bank commissions for the method used;
   - Between 7 and 2 days before the event, the number of fidelity points awarded is equal to 50% of the amount of the service purchased, net of bank commissions for the method used;
   - In the 48 hours preceding the event, no fidelity points will be awarded

9.5 The same treatment will also be applied to each Customer who chooses a hybrid payment method, i.e. books with one of the available payment methods by adding fidelity points in order to lower the overall cost of the cart.

9.6 Each customer who decides to book or pre-purchase services using only fidelity points, PrenoPoints, will be entitled to the crediting of fidelity points without further deductions, according to the following methods:

   - Up to 48 hours before the event, the number of fidelity points awarded is equal to 100% of the points used;
   - Up to 24 hours before the guided tour, the number of fidelity points awarded is equal to 50% of the points used;
   - even in case of withdrawal on the day of the event or no show, you will be entitled to 10% of the points used


10. Right of Cancellation

10.1 The services described that make up the EasyPreno offer may be subject to cancellation by unilateral decision of the Owner. All Users who have purchased a service subject to cancellation will be promptly informed by email.

10.2 Customers who have made the reservation or pre-purchase using an available payment method or hybrid payment with the addition of PrenoPoints will be credited with fidelity points of a value equal to 100% of the amount of the Product purchased, minus any bank commissions incurred by I.A.M.G. Project, which can be used on the Site for the purchase of any product and/or service.

10.3 Customers who have made the reservation or pre-purchase exclusively through PrenoPoints will be credited with 100% of the points used without further commissions, which can be spent on the Site for the purchase of any product and/or service. 

Users who have made the reservation or pre-purchase exclusively by means of an available payment method (art.6.2), without the use of loyalty points, may request a cash refund by bank transfer, net of a processing fee of €5.00 for each order subject to the request, as an alternative to returning the value of the purchase in loyalty points from which the any bank commissions.


11. Exemption from guarantees and liability

11.1 Except for the cases expressly indicated in these conditions, I.A.M.G. Project cannot be held responsible for any type of damage deriving from the lack of accuracy, completeness and updating of the information provided by the Organizers, nor for any errors or omissions concerning the contents inserted by them. I.A.M.G. Project has no obligation to verify or control the content and information provided by the Organizers. I.A.M.G. Project is not responsible for the content, data and/or information provided by the Organizers on this site, nor for the content of external links reported by them. In particular I.A.M.G. Project does not guarantee that these contents are correct.
The Organizer is solely and ultimately responsible for the products and/or services covered by the contract with the User and for the data entered in the advertisement promoted through the site.
I.A.M.G. Project reserves the right to eliminate any fraudulent or non-compliant content on the site at any time and without notice.

11.2 I.A.M.G. Project is not responsible for errors and/or omissions that may interfere with the successful outcome of the transaction and therefore the use by the User. The Organizer, as direct and sole responsible, will take charge of the compensation in favor of the User, and where necessary in favor of I.A.M.G. Project, according to the procedures established by law.

11.3 I.A.M.G. Project is not responsible for the opinions expressed by Users on the website, forum, community or other participation platform.

11.4 I.A.M.G. Project strives to keep its Site available at all times. However, it cannot ensure the continuity of the service which could be interrupted due to technical reasons (short anomalies or delays in temporary services for reasons such as maintenance, security, updating in order to modernize or improve the Service), due to problems beyond I.A.M.G. Project's control (e.g. telecommunication network problems, power outages, etc.), whether due to problems resulting from the User’s negligent or harmful behavior or as a result of force majeure. For the purposes of this contract, the concept of force majeure means all events occurring beyond the control of I.A.M.G. Project, such as bankruptcies of third parties, operators or service companies, actions of the government, lack of access to third party networks, actions or omissions of public authorities, problems deriving from natural phenomena, blackouts, etc.
I.A.M.G. Projecttherefore assumes no responsibility, to the maximum extent permitted by law, for any type of damage that may derive from the lack of availability or continuity of the website and related services. If an interruption of the service causes the cancellation of content or reservations or causes errors that occur when logging into your account or while browsing the Site, I.A.M.G. Project cannot be held responsible in any way.

11.5 I.A.M.G. Project may modify, without notice and at any time, the design, presentation and/or configuration of this website, some or all of its services, and add new ones.

11.6 I.A.M.G. Project will not be responsible for cases of unfair competition and illicit advertising deriving from the services rendered by third parties through the website, for the lack of accuracy, completeness, relevance, fault and/or updating of the contents transmitted, received, obtained, stored, made available or accessible through services provided by third parties through this website.

11.7 I.A.M.G. Project will not be held responsible in any way for the services rendered or for the results obtained from third party sites and/or partner sites.

11.8 I.A.M.G. Project, the partner companies, directors and/or employees will in no case be liable for all types of damages that may arise from services provided by third parties through this website, from loss of profits or from indirect, consequential, special, accessory or punitive damages deriving, based on or resulting from the website, these Conditions, the User's use of the Website and/or any transaction between Users, even if I.A.M.G. Project has been advised of the possibility of such damages.

11.9 These limitations and exclusions apply regardless of the cause of damages, whether due to breach of contract, breach of warranty, strict liability, unlawful act, negligence or any other legal basis, to the maximum extent that such exclusions and limitations are not prohibited by the law in force.

11.10 If the User is not satisfied with the Site or does not fully accept the clauses of these Conditions, the cessation of use of the Site will be the sole and exclusive remedy against I.A.M.G. Project.


12. Ineffectiveness and partial nullity

12.1 If any provision of these conditions is found to be null, invalid or ineffective, it will lose all or part of its effectiveness.
The remaining clauses will remain fully effective without any type of derivative conditioning.


13. Place of Jurisdiction

13.1 The Court of Pavia is competent for all disputes.
The exclusive jurisdiction of the consumer is an exception, if the Law so provides.


14. Online dispute resolution for consumers

14.1 The consumer residing in Europe should be aware of the fact that the European Commission has set up an online platform which provides an alternative dispute resolution tool.
This tool can be used by the European consumer to resolve any dispute relating to and/or deriving from contracts for the sale of goods and services entered into on the net in a non-judicial manner.
Consequently, if you are a European consumer, you can use this platform for the resolution of any dispute arising from the online contract stipulated with the Owner.

15. Amendments to these Terms

15.1 The Owner reserves the right to make changes to the Terms at any time, notifying the User by posting them on the site.
The User who continues to use the site after the publication of the changes accepts the new Terms without reservation.
